1. Agreement to Terms

By accessing or using the website and services of Florida Curriculum Consulting LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Florida Curriculum Consulting LLC provides educational consulting services to Florida homeschool families, including but not limited to:

• ESA compliance guidance and account navigation
• Onboarding and orientation sessions
• Annual compliance monitoring
• Purchasing matrix reviews
• Deadline tracking and notifications
• One-on-one consulting sessions with ESA specialists

Florida Curriculum Consulting LLC is an approved Step Up For Students Choice Navigator and a registered provider in the EMA marketplace. We are an independent business and not a government agency. We do not administer scholarships, determine eligibility, approve purchases, or decide award amounts. Those decisions rest with Step Up For Students and the Florida Department of Education.

3. Eligibility

To use our services you must:

• Be at least 18 years of age
• Be a parent or legal guardian of a child enrolled in or applying to Florida's ESA program
• Provide accurate and complete information when registering
• Agree to comply with all applicable Florida state laws regarding ESA usage

4. User Accounts

When you create an account with us you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms.

5. Payments and Billing

Fees:All service fees are clearly displayed at the time of purchase. By completing a purchase you authorize us to charge the stated amount to your selected payment method.

Refund Policy:

• Cancel at least 24 hours before your scheduled session and you will receive a full refund, processed within 24 hours of your request.
• No card is held on file and there is no late cancellation or no-show fee. Families paying with PEP or FES-UA scholarship funds are never asked to enter card information at all.
• Once a session has taken place and the deliverable has been provided, that service is considered complete. If something has gone wrong, contact me and we will make it right.

Subscription Services:If you purchase a recurring subscription, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel at any time through your account settings.

6. Disclaimer of Warranties

Our services are provided for informational and guidance purposes only. Florida Curriculum Consulting LLC:

• Is not a law firm and does not provide legal advice
• Is not a financial advisor and does not provide financial advice
• Cannot guarantee specific outcomes regarding ESA approvals or compliance rulings
• Does not guarantee that following our guidance will prevent audits or penalties

All information is provided "as is" without warranty of any kind. We strongly recommend consulting a licensed attorney or financial advisor for legal or financial matters.

7. Limitation of Liability

To the fullest extent permitted by law, Florida Curriculum Consulting LLC shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of ESA funds resulting from client decisions
• Errors or omissions in information provided
• Third-party actions or decisions including those made by Step Up For Students or state agencies
• Service interruptions or technical issues

Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days prior to the claim.

8. Intellectual Property

All content on our website including text, graphics, logos, images, and downloadable materials is the property of Florida Curriculum Consulting LLC and is protected by copyright law. You may not:

• Reproduce or distribute our content without written permission
• Use our materials for commercial purposes
• Remove any copyright or proprietary notices
• Create derivative works based on our content

9. Prohibited Conduct

When using our services you agree not to:

• Provide false or misleading information
• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm our staff or other users
• Share your account credentials with others
• Use our content to create competing services

10. Third-Party Services

Our website may integrate with or link to third-party platforms including payment processors, scheduling tools, and email services. We are not responsible for the terms, privacy practices, or performance of any third-party services.

11. Termination

We reserve the right to suspend or terminate your access to our services at any time for:

• Non-payment of fees

Upon termination, your right to use our services will immediately cease.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Orange County, Florida.

• Sending an email notification to registered users
• Displaying a notice on our website

Continued use of our services after changes take effect constitutes your acceptance of the revised terms.
